How to start a photography business
What it costs, what you file, what it earns and what ends most of them. Every number below is cited to where it came from.
No government or peer-reviewed source publishes a startup cost range for a photography business, so no figure is quoted here. The hardest part is price competition against a very large pool of self-employed competitors in a flat-to-shrinking market.
What it costs to start
No primary source publishes thisNo primary US source publishes a photography-specific startup cost range; the Census Annual Business Survey general anchor (24.1% of new US employer businesses started with under $5,000, 50.9% under $25,000) is the only credible reference point, and the costs that actually dominate are camera bodies, lenses, lighting and backup storage plus equipment and liability insurance, which push a photography start-up above a purely advisory service business.
What you have to file
Licensing is set by state, county and city, so this is what the category tends to require rather than a list for where you live. The state pages below carry the filing detail for each of the 50.
- Business entity registration with the state Secretary of State, or a DBA / assumed-name filing
- IRS Employer Identification Number (EIN)
- State and/or city general business licence or tax registration
- STATE SALES TAX PERMIT, photography is one of the service businesses most likely to owe sales tax, because photographs are usually treated as tangible personal property or taxable digital goods. Washington State's Department of Revenue photography tax guide is a documented example: photographers must collect retail sales tax on photos delivered to in-state customers, digital photos received electronically are taxable retail sales, and all sitting/session/shooting fees are taxable whether the deliverable is a print or a digital file. Washington also applies its B&O gross-receipts tax under Retailing, Service and Other Activities, Royalties or Wholesaling classifications depending on the work. Rules differ by state, check your Department of Revenue before assuming session fees are untaxed
- Reseller / resale permit to buy prints, albums, frames and packaging without paying sales tax, for resale
- FAA Part 107 Remote Pilot Certificate for any commercial drone photography, applicants must be at least 16, able to read, speak, write and understand English, in a fit condition to operate safely, and must pass the Unmanned Aircraft General Small (UAG) aeronautical knowledge exam, complete FAA Form 8710-13 via IACRA, pass a TSA background check, and complete online recurrent training every 24 calendar months. Drones used commercially must also be registered with the FAA
- US Copyright Office registration of your images, group registration options exist specifically for photographers: GRUPH (Group Registration of Unpublished Photographs) and GRPPH (Group Registration of Published Photographs)
- Written client contracts plus model releases and property releases for any image you intend to license commercially
- General liability insurance, routinely required by wedding and event venues as a condition of access
- Inland marine / equipment coverage for cameras and lighting (standard commercial property policies often exclude gear taken off premises)
- Professional liability / errors & omissions cover for failure-to-deliver and lost-image claims
- Workers' compensation, unemployment insurance and (in some states) disability insurance if you hire second shooters or assistants as employees rather than contractors
- Location permits where applicable, national and state parks and many municipalities require permits for commercial shoots
What the margins look like
No primary source publishes a profit margin for this business. IRS Statistics of Income does not break out a line this specific, and the percentages in wide circulation come from vendor surveys and market research whose samples and methods are not published, so none is quoted here.
Whether demand is growing
Shrinking
Slightly declining: BLS projects employment of photographers to fall 1% between 2025 and 2035, with about 10,700 openings a year still projected on average over the decade, largely from replacement rather than growth.
How big the market is
67% of US photographers are self-employed, by far the highest self-employment rate of the five business types covered here, out of 145,000 people employed in the occupation in 2025.
The part that ends most of them
Price competition against a very large pool of self-employed competitors in a flat-to-shrinking market. With 67% of photographers self-employed and BLS projecting a 1% decline through 2035, differentiation and repeat/referral business matter more than capability; the Federal Reserve's 2026 Report on Employer Firms separately found 'reaching customers and growing sales' the most common operational challenge for small employer firms generally. Sales tax on session fees and digital delivery is the most commonly missed compliance item.
Before you start
- What it will cost you, since the numbers above are the category and not your version of it
- Sole proprietor, LLC or S corp, what actually differs, with no recommendation
- What your state wants filed, read from the state's own pages
- What you have to sell to break even, which decides whether the margin above matters
- Which way you actually work, if the choice between these is really a choice about you
